TERMS OF SERVICE

1. SLOTS + INVOICES
• Slots are only claimed after payment is received. Until the invoice expires, Slots are held unless otherwise listed.
• Once delivered to the provided email, Commission invoices will be due by the next day
(Example: Invoice sent on the 15th, it'll be due on the 16th).
• If not paid within a 12 to 24 hour time frame, the commission will be canceled and another Client will be selected.
2. PAYMENT
• Payment is done with and through PayPal invoice only.
3. SALES AND COMMISSION CANCELLATION
• Unless I am unable to complete the commission, all sales are final. Should this ever occur, I will refund the Client equal to the amount of work done.
4. REFUSED FETISHES AND DECLINED COMMISSIONS
• I will not do Adult Cub/Pedophilia, Snuff, Rape, Hyper Muscle, Scat, or Humorously Offensive artworks.
• If uncertain of a fetish, refer the Fetish Will-Do/Won't-Do card. Should the fetish in question not be present, send an on-site message to check if it's accepted or declined.
• I reserve the right to decline ANY fetish type, commission(s) and or Client, with or without a reason/explanation.
5. UPLOADS AND RE-POSTING
• If WIPs (works in progress) are provided, Clients may not share and or upload any WIPs of the commission(s).
• When finished, Clients may upload their purchased commission(s) ahead of me to their galleries.
• If uploading the finished commission, Credit must be provided—a link back to my account or name is acceptable. The same will be done for the Client(s) unless otherwise requested.
• By commissioning me, Clients understand that I reserve the right to upload any commissioned artwork I produce to my galleries, with or without Client(s) permission.
• Only Clients and individuals with my or the Client's permission may re-post/re-upload commissioned artworks -- If/when granted permission, provide credit to both I, the artist, and the Client.
• Clients and third parties may not edit or remove my watermark on the commission, it stays on the commissioned artwork at all times.
6. COPYRIGHTS AND OWNERSHIP
• Commissioned artworks I do are for Noncommercial use only.
• Do not resell or use in commercial purposes unless I agree to it.
(Example: Buy a commission from me, then resell it, sell for a higher price, or resell the commission multiple times.)
• If you want another artist to finish or change the commissioned artwork(s) I produced, seek permission from me first.
• The commissioned artwork and the copyrights to the image belong strictly to I, the artist.
(If all rights or commercial use of the image is desired, pricing can be negotiated.)
• All copyrights that belong to the Client (i.e., original characters, props, clothing, etc.,) belong to the Client.
7. FORM AND WORKING TIME
• It will work because of its difficulty. That means that if a simpler commission arrives it will surely be dispatched first.
• Adjustments are made in the SKETCH stage, then changes will not be accepted.
• Orders will be placed within two weeks to two months once on the list.
• Once the work is finished, delivery will be made via mail. Failing that, delivery can also be made through Sta- Devianart
• You can request the .pds file before delivery, after that I do not make sure you have the file.
• Once the work is delivered, the client will be responsible for the files.
• I reserve the right to refuse to make ANY commission request for any reason.
• I reserve the right to make color modifications if necessary for a better composition.
Terminos y Condiciones
1. SLOTS + FACTURAS
• Los slots solo se ocupan luego de recibido el pago. Hasta que expire la factura, los slots permanecen ocupados a menos que se indique lo contrario.
• Una vez enviado al correspondiente email, las facturas de comisión estarán vencidas para el dia siguiente.
(Ejemplo: Factura enviada el 15, estará vencida para el 16)
• De solicitarse, se puede esperar un máximo de 5 días para realizar el pago, de no efectuarse no aseguro realizar su pedido.
2. PAGO
• Los pagos son exclusivamente a través de:
Mercado Pago: 10% de recargo
Transferencia bancaria
Paypal (internacional)
3. VENTAS Y CANCELACIÓN DE COMISIONES
• A menos que no pueda completar/finalizar la comisión, todas las ventas son absolutas.
• Si esto llegase a pasar, haré un reembolso al cliente correspondiente al porcentaje de trabajo hecho.
(osea, no reembolsos por ningún motivo además de la incapacidad para trabajar por x motivo)
4. FETICHES Y/O COMISIONES RECHAZADAS
• No trabajo/hago/dibujo Yiff Cub/pedofilia, Snuff, violación, hyper musculatura, scat o humor ofensivo.
• De haber dudas con un fetiche, revisar la lista de Fetish Will-Do/Won't-Do. De no estar presente el fetiche en cuestión, mandar mensaje privado para verificar si es aceptado o no.
• Me reservo el derecho de rechazar CUALQUIER clase de fetiche, comisiones y/o clientes, con o sin motivo/razón.
5. POSTEO Y RE-POSTEO
• En caso de haber recibido WIPs de la comisión, el cliente no debe compartir ni postear/subir ninguno de estos.
• Finalizada la comisión, el cliente tiene permiso de postearla en sus redes/galerías antes que yo.
• En caso de postear la comisión finalizada, se ruega proveer el crédito al artista, un link/la url de mi cuenta o solo mi nombre es aceptable. Esto también será hecho para el cliente a menos que se indique lo contrario.
• Al comisionarme, mis clientes entienden que me reservo el derecho de postear cualquier comisión que produzca en mis galerías, con o sin el permiso del cliente.
• Solo clientes y allegados a mi o al cliente, con su debido permiso, podrán re-postear/re-subir comisiones. En caso de tener permiso, se debe dar crédito a ambos el artista y el cliente.
6. DERECHOS DE AUTOR Y DE PROPIEDAD
• Las comisiones que yo produzca será exclusivamente de uso no-comercial.
• No han de venderse ni usarse por razones comerciales sin mi permiso.
(Ejemplo: Comisionarme, y luego revender la comisión, a un precio más alto, o revender la comisión varias veces)
• En caso de querer que otro artista finalice o cambie una de mis comisiones, se ruega pedirme permiso primero.
• La comisión y derechos de autor de la imagen me pertenecen estrictamente a mi, el artista.
(Si se desean todos los derechos o derechos comerciales de la imagen, se puede negociar un precio a cambio)
• Todos los derechos que pertenezcan al cliente (Ej: OCs, accesorios, ropa, etc) pertenecen al cliente.
7. FORMA Y TIEMPO DE TRABAJO
• Se trabajará por dificultad de la misma. Eso quiere decir que si llega una comisión más sencilla seguramente sea despachada primero.
• Los ajustes se realizan en la etapa de BOCETO, luego no se aceptarán cambios.
• Los pedidos se realizarán en el plazo de dos semanas a dos meses una vez en el listado.
• Una vez finalizado el trabajo se realizará la entrega via mail. En su defecto también se puede realizar la entrega por medio de STA- Deviantart
• Se puede solicitar el archivo .pds antes de la entrega, luego de ello no aseguro de que tenga el archivo.
• Una vez entregado el trabajo el cliente será responsable de los archivos.
• Me reservo el derecho de negarme a realizar CUALQUIER solicitud de comisión por cualquier motivo.
• Me reservo el derecho de hacer modificaciones de color si es necesario para una mejor composición.
